Terms and Conditions of VILA VITA Giveaways with Data Protection Notices

These terms and conditions govern participation in the competition of VILA VITA Marburg SE, Anneliese-Pohl-Allee-17, 35037 Marburg (hereinafter "Organizer"). The data protection notices inform you about the processing of your personal data by the organizer in connection with the competition.

1. By participating in the competition, the participant accepts these terms and conditions.

2. The competition begins on 29.01.2026 at 12:00 and ends on 06.02.2026 at 23:59.

3. The prize includes 1x two tickets for the Easter brunch at Hofgut in Dagobertshausen.

4. Participation in the competition is free of charge.

5. To participate in the competition, it is necessary to like the post and tag a person under the competition post with whom you would like to experience the event. For an additional entry in the pot, the post can be reposted in the story.

6. Only adults with permanent residence in the Federal Republic of Germany are eligible to participate. Employees of the organizer as well as employees of service providers and other cooperation partners involved in the creation or handling of the competition are excluded. There is no obligation to use services of the organizer or the VILA VITA group of companies.

7. All persons involved in the creation and implementation of the competition and employees of the organizer and the VILA VITA group of companies as well as their family members are not eligible to participate. The organizer may also, at its own discretion, exclude persons from participation if there are justified reasons, particularly in the case of false or incomplete information provided by the participant, if unauthorized aids are used, or if there is suspicion of manipulation.

8. The winners will be determined by drawing after the end of the competition. If the competition is linked to a task (e.g., answering a question or similar), only those participants who have correctly answered or completed the task will be included in the draw. The determination of the winner will take place promptly after the end of the competition.

9. The winner(s) will be personally notified and asked for confirmation. Notification can be made by mail, email, or phone. If participation occurs via a social network (e.g., Facebook, Instagram, etc.), notification can also be sent to the participant's user account in the respective social network. If a participant does not confirm acceptance of the prize within 4 weeks, the prize will be forfeited. If the provided contact options are incorrect (e.g., invalid email addresses), the organizer is not obligated to find correct addresses. The disadvantages resulting from the provision of incorrect contact data are borne by the participants.

10. The delivery of the prize is exclusively to the winner or their legal representative. A cash payment of the prize, its exchange, or transfer to other persons is not possible. Only one prize is possible per participant. The handover of the prize will be individually coordinated with the winner. If a participant waives the prize, the next participant in the winner ranking will take their place.

11. The organizer reserves the right to change or terminate the competition without prior notice and without giving reasons, especially if an attempted abuse through manipulation is detected or proper execution can no longer be ensured. If circumstances arise that the organizer is not responsible for, the respective winner accepts an appropriate substitute prize. Such circumstances not to be represented are particularly those that lie with the sponsors of the prizes.

12. If the competition involves images or photos submitted by the participant or posted on a social network, the participant guarantees to be the owner of the necessary rights to the submitted or uploaded photos/images. The organizer is not obligated to check the content provided by participants for potential violations of third-party rights. The organizer is entitled to reject these if the content is deemed illegal or violates good morals. If the participant is not the sole author or rights holder, they expressly declare to have the necessary rights for participation in the competition. The participant grants the organizer the following simple, temporally and spatially unlimited but non-exclusive rights of use to the photos/images used (a) the right to store the photo/image on a server, (b) the right to make the photo/image available to the public in whole or in part via Facebook and our websites, (c) the right to use the photo/image to promote our products, and (d) the right to edit the photo/image, provided it is not distorted. The organizer will appropriately credit the author when using the photo/image, as far as this is reasonable and possible considering the specific form of use.

13. The participant guarantees that they will not send content whose provision, publication, or use violates applicable law or third-party rights. The participant indemnifies the organizer from claims of third parties of any kind resulting from the illegality of photos used by the participant. The indemnification obligation also includes the obligation to fully indemnify the organizer from legal defense costs (e.g., court and attorney's fees).

14. For competitions of the organizer on Facebook and/or Instagram, the following note also applies: The competition is not connected to Facebook or Instagram. It is in no way sponsored, supported, or organized by Facebook or Instagram. The recipient of the data provided by the participant is not Facebook or Instagram, but the organizer. The participant releases Facebook and Instagram from any liability arising from claims related to the execution of the competition. All inquiries, comments, or complaints about the competition should be directed directly to the organizer and not to Facebook or Instagram.

15. For competitions of the organizer on Instagram, the following note also applies: The competition is not connected to Instagram. It is neither sponsored, supported, nor organized by Facebook.

16. If a clause of these terms and conditions is invalid, the validity of the remaining conditions remains unaffected.

17. Legal recourse is excluded.

1. The responsible entity for data processing is VILA VITA Marburg SE, Anneliese-Pohl-Allee-17, 35037 Marburg (hereinafter "Responsible").

2. When you participate in the competition, we process the personal data you provide on the participation or competition card or the participation form. Depending on the type of competition, these are mainly:

  • Salutation
  • First and Last Name
  • Postal Address
  • Phone/Mobile Number
  • Email Address
  • Date of Birth
  • Information on Social Networks (User ID, Profile Picture)
  • Images/Content submitted by you

3. The purpose of data processing is to conduct the competition. This also includes checking whether you are eligible to participate and determining and notifying the winners. Without providing personal data, participation in the competition or notification of the winners is not possible. The legal basis for processing your personal data is Art. 6 para. 1 lit. b GDPR. Your data will be deleted no later than 30 days after the end of the competition.

4. If you have given separate consent, we will also use your data to inform you about interesting products, offers, and news from the VILA VITA Group (VILA VITA Hotel & Touristik GmbH, VILA VITA Marburg SE, Congresszentrum Marburg GmbH & Co. KG). The legal basis is then your consent according to Art. 6 para. 1 lit. a GDPR. Further information can be accessed at www(dot)vilavitamarburg(dot)de/datenschutz. The consents given can be revoked at any time in whole or in part with effect for the future. The revocation can be made informally to the address above or to datenschutz(at)vilavitahotels(dot)com.

5. In principle, we do not pass on your data to third parties unless a transfer is necessary for conducting the competition or sending the prizes and there is a legal basis that allows us to pass on your data. We may also use service providers to process personal data. These act as processors for us and are bound by instructions.

6. Your data is generally processed at locations within the Federal Republic of Germany or the European Economic Area (EEA). If data is processed outside the EEA, this only occurs if an adequate level of data protection according to Art. 44 ff. GDPR has been confirmed by the EU Commission in the third country or other appropriate guarantees for the protection of personal data are in place.

7. You have the right to 

  • Information according to Art. 15 GDPR,
  • Correction according to Art. 16 GDPR,
  • Deletion according to Art. 17 GDPR,
  • Restriction of processing according to Art. 18 GDPR and
  • Data portability according to Art. 20 GDPR.

For the rights to information and deletion, the restrictions of §§ 34 and 35 BDSG apply. In addition, you have the right to lodge a complaint with a data protection supervisory authority according to Art. 77 GDPR in conjunction with § 19 BDSG. Furthermore, you have the right to object to processing within the framework of legal provisions.
